Protected TreesIf you are planning to carrying out tree work you will need permission from the Council to undertake work to any TPO protected tree(s) or trees in Conservation Areas.
How to apply
If your tree is protected by a TPO, or meets the criteria below then you must make a Tree Works Application form before carrying out any work. You are encouraged to obtain a tree report and submit this along with your application. This can be obtained from a qualified Arboricultural Consultant or Tree Surgeon/Contractor.
- If the tree(s) are covered by a Tree Preservation Order (TPO).
- Trees within a Conservation Area (CA). The Council requires no less than 6 weeks' notice before you plan to start tree works.
- If the tree(s) are protected by a condition on a planning consent then you might have to submit a new planning application to vary the terms of the original consent.
- The above form will also need to be submitted where a condition on a planning consent might require that permission in writing is obtained prior to any work being carried out to trees.
Completed forms should be returned to Planning (planning@stirling.gov.uk) or posted to the address on the back of the form.
It is an offence to cut down, lop, top, uproot or wilfully damage or destroy a protected tree without the Council's permission. Carrying out work to protected trees without permission can lead to a fine of up to £20,000.
Exemptions - Emergency Work to Protected Trees
If a tree is dead, dying or in a dangerous condition then it may be exempt from requiring permission for works to be carried out. In such circumstances:
- You still have a duty to notify the Council in writing of any proposed works.
- Notice should be given at least 5 days before any work commences, or be given as soon as possible after any work has taken place.
- Proof of the condition of the tree, prior to work being carried out, must be provided along with the notification. This should be provided by a suitably qualified Arboricultural Consultant or Tree Surgeon.
In the event of an emergency you do not have to apply, but it is essential to collect photographic evidence of the trees, along with an Arboricultural report to be submitted no later than 5 days after the removal of the danger. Replanting of any felled trees will normally be required.
