A Stirling newsagent has been banned from selling tobacco products for two years following an investigation by Stirling and Clackmannanshire’s Trading Standards Service.

The Council applied for a tobacco retailing ban against Turnbulls (Stirling) Limited, Glasgow Road, Stirling after they were caught breaching the tobacco display ban on two occasions and failing to display a statutory tobacco notice.

Stirling Sheriff Court granted the banning order on Monday 29 May 2017.

Despite repeated warnings and several advisory visits and guidance from Stirling and

Clackmannanshire’s Trading Standards team, the trader continued to breach the tobacco display ban and tobacco products were found on display within the premises. 

Trading Standards sought an order from the court banning the company from selling tobacco products.

The service have said that this was an extreme case and the majority of tobacco retailers in the area comply with the law.   Those found not complying usually take on board advice given to them and rarely fail to comply a second time. 

Trading Standards are pleased with the outcome of this case, however, prefer to work with tobacco retailers to prevent matters like this being taken to court.

Councillor Jim Thomson, Environment & Housing Committee Convener, said: “The ban removing tobacco from open view is to discourage young people from taking up smoking and also to improve peoples’ health. 

“It is regrettable that anyone would want to flaunt a law that has the general support of the public and has been proven to protect children and young people.”
